Welcome to Trebuchet. These Terms of Use (“Terms”) govern your access to and use of trebuchet.agency and any webpages that link to these Terms (collectively, the “Site”).
The Site is operated by Trebuchet Marketing LLC (“Trebuchet,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
1. Using the Site
You may use the Site for lawful, informational, and legitimate business purposes.
You agree not to:
- Violate any applicable law or regulation.
- Interfere with the Site’s operation, performance, or security.
- Attempt to gain unauthorized access to the Site or related systems.
- Introduce viruses, malicious code, or other harmful material.
- Scrape, crawl, harvest, or collect Site content or visitor information through unauthorized automated means.
- Impersonate another person or misrepresent your identity or affiliation.
- Use the Site to transmit unlawful, misleading, abusive, or infringing material.
- Copy, modify, distribute, or commercially exploit Site content without authorization.
- Help another person engage in any prohibited activity.
We may restrict or terminate access to the Site if we reasonably believe these Terms have been violated.
2. No Client Relationship
The Site provides general information about Trebuchet and our services. Visiting the Site, submitting a contact form, or communicating with us does not create an agency-client, advisory, fiduciary, or other professional relationship.
A client relationship begins only when Trebuchet and the client enter into a separate written agreement.
Nothing on the Site is legal, financial, accounting, or other regulated professional advice.
3. Project Inquiries
You may use the Site to contact us about potential projects or services. Submitting an inquiry does not guarantee that we will accept a project, respond within a particular period, or provide any requested service.
Please do not submit confidential, proprietary, or sensitive information before we have entered into an appropriate written agreement. Information submitted before then may not be treated as confidential.
4. Intellectual Property
The Site and its contents—including text, designs, graphics, illustrations, photographs, videos, audio, logos, trademarks, service marks, software, and overall look and feel—are owned by or licensed to Trebuchet and are protected by intellectual-property laws.
Trebuchet grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal or internal business purposes.
Except as expressly permitted by law or approved by us in writing, you may not:
- Copy, reproduce, republish, or distribute Site content.
- Modify, translate, reverse engineer, or create derivative works from the Site.
- Use Trebuchet’s name, branding, logos, or trademarks.
- Remove copyright, trademark, or ownership notices.
- Use Site content to train or improve an artificial-intelligence or machine-learning system.
No rights are granted by implication.
5. Portfolio and Case-Study Content
The Site may feature campaigns, creative work, client names, trademarks, performance examples, or case studies. Rights in third-party materials remain with their respective owners.
Results described on the Site are examples only. Past performance does not guarantee future results. Marketing outcomes depend on many factors, including audience, offer, budget, timing, market conditions, platform changes, and execution.
In other words: strong work matters, but there is no magic “launch” button.
6. Artificial-Intelligence Content
Trebuchet may use artificial-intelligence tools to support research, strategy, ideation, analysis, content development, or other aspects of our work and Site.
AI-assisted material may contain inaccuracies, omissions, or unexpected results. Site content should not be treated as a substitute for professional judgment or independent verification.
Specific terms governing AI use in client work will be addressed in the applicable client agreement.
7. Feedback and Submissions
If you voluntarily send us suggestions, ideas, feedback, or other non-confidential material, you grant Trebuchet a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, and incorporate that material for any lawful purpose without compensation or attribution.
You represent that you have the necessary rights to submit the material and that our permitted use will not violate another party’s rights.
This section does not apply to personal information, which is handled according to our Privacy Policy.
8. Third-Party Services and Links
The Site may contain links to or integrations with third-party websites, platforms, applications, and services.
Trebuchet does not control and is not responsible for third-party content, availability, security, terms, or privacy practices. A link does not necessarily mean that Trebuchet endorses the third party.
Your interactions with third-party services are governed by their own terms and policies.
9. Site Availability and Changes
We may update, suspend, restrict, or discontinue any part of the Site at any time. We do not guarantee that the Site or any content will always be available, uninterrupted, secure, complete, or error-free.
We are not responsible for losses caused by Site downtime, technical failures, maintenance, or circumstances outside our reasonable control.
10. Disclaimers
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.”
Trebuchet disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, accuracy, availability, and non-infringement.
We do not warrant that:
- The Site will meet your requirements.
- Site content will be accurate, complete, or current.
- The Site will be uninterrupted, secure, or error-free.
- Defects will be corrected.
- The Site will be free from viruses or other harmful components.
- Any particular business or marketing result will be achieved.
Some jurisdictions do not permit certain warranty exclusions, so parts of this section may not apply to you.
11. Limitation of Liability
To the fullest extent permitted by law, Trebuchet and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising from or connected with the Site.
This includes loss of profits, revenue, business opportunities, goodwill, data, or use, even if we were advised that such damages were possible.
To the fullest extent permitted by law, Trebuchet’s total liability for all claims arising from or relating to the Site will not exceed $100.
These limitations do not apply where liability cannot legally be excluded or limited.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Trebuchet and its owners, officers, employees, contractors, and affiliates from claims, liabilities, damages, judgments, losses, and reasonable costs arising from:
- Your misuse of the Site.
- Your violation of these Terms.
- Your violation of applicable law.
- Material you submit through the Site.
- Your infringement of another party’s rights.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law principles.
Any legal proceeding relating to these Terms or the Site must be brought exclusively in the state or federal courts located in Milwaukee County, Wisconsin, and each party consents to those courts’ jurisdiction and venue.
14. Changes to These Terms
We may update these Terms periodically. Changes become effective when the revised Terms are posted, unless a later date is stated.
The effective date at the top indicates when these Terms were last updated. Your continued use of the Site after revised Terms take effect constitutes acceptance of those changes.
15. General Provisions
If any provision of these Terms is found unenforceable, it will be modified only as much as necessary, and the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver of that provision or our right to enforce it later.
These Terms, together with our Privacy Policy and any other notices posted on the Site, constitute the entire agreement concerning your use of the Site. Separate written agreements govern Trebuchet’s services for clients.
You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations as part of a merger, acquisition, reorganization, asset sale, or operation of law.
